SHARK offers the possibility to submit reviews on its website accessible at the address https://www.shark-helmets.com.
Publishing a review on the Site implies acceptance and compliance with these publication conditions (hereinafter referred to as the "Publication Conditions"). SHARK reserves the right to modify them at any time. If necessary, we will inform you by changing the date located at the bottom of these Publication Conditions and, in some cases, we will provide additional notifications (for example, by posting a statement on the home pages of our Site or by sending you an email).
Article 1 - Purpose of the Site's review feature
1.1 The review feature allows its users to leave reviews, advice, tips, suggestions, information, recommendations on products sold by SHARK and to give them a rating that can range from one star (for "Poor") to five stars (for "Excellent").
1.2 The company SHARK provides users (hereinafter referred to as the "User(s)") with a space to store only their reviews for dissemination on all current and future public communication media of SHARK, including but not limited to electronic communication services (notably the 2RIDE Group's merchant sites and/or any possible mobile device version) and marketing and/or advertising communication media (emailing, mailing, online advertising banners, promotional materials in SHARK stores, etc.) published by SHARK.
Article 2 - Submission, badges, and ranking of reviews
2.1 Any User of the SHARK review feature must accept the Publication Conditions. SHARK may ask any minor User to justify this authorization and, failing that, refuse to publish a review.
2.2 Users have the option to submit their reviews according to the following methods:
- spontaneously, on their own initiative, by clicking on "Give your review" on the page of the concerned product. In such a case, SHARK is not able to confirm that the User is submitting a review on a product they have actually purchased or tested. These are reviews for which no badge or specific mention is affixed as well as those identified by a "spontaneous review" badge.
- following the receipt of an email inviting them to give their opinion on a product they purchased from SHARK. These reviews being solicited by SHARK following a purchase, they are identified on the Site by a "verified buyer" badge.
2.3 Reviews are displayed by default in chronological order, from the most recent to the oldest, but users can choose to display them according to other criteria such as usefulness or rating.
Article 3 - Content of Reviews / User Responsibilities
3.1 A review must include a nickname, an evaluation, a title, and a description of at least 50 characters.
3.2 The review feature cannot be used as a platform for disseminating content that contravenes good morals, public order, the rights of others, or applicable laws and regulations such as, notably:
- defamatory, insulting, obscene, racist, offensive messages or those mentioning illegal activities of all kinds their forms.
- any abuse in the exercise of freedom of expression, such as statements consisting of systematic or non-objective criticism, as well as statements of a denigrating or malicious nature.
- content that would be violent, pornographic, or likely to infringe on the respect of human beings or their dignity, equality between women and men, or the protection of children and adolescents.
- statements or messages inciting the commission of crimes and offenses, violence, discrimination, or racial hatred.
- impersonation of a name, email, or company name.
- the total or partial reproduction of content protected by intellectual property rights for which Users do not have rights, as well as messages constituting trademark infringement.
3.3 Users are prohibited from misusing the review feature for propaganda, solicitation, canvassing, or proselytizing for professional, commercial, or political purposes (advertisements, "spam" content, or references to other products, commercial offers, or websites...).
3.4 Reviews must not contain, in particular:
- email addresses, URLs, phone numbers, postal addresses, or other information (name, first name...) that would allow the User or a third party to be identified.
- critical comments on other reviews published, especially on the Site or about their authors.
- comments on the medical effectiveness of products.
- comments relating to another product or issues encountered during orders (delivery problems...).
- comments encouraging purchases from a competitor of SHARK.
3.5 The content of the reviews must not contradict these Publication Conditions.
3.6 Users are also prohibited from hindering or disrupting the operation of the review feature of SHARK.
Users are prohibited from incorporating documents or software into reviews posted in the storage space provided by SHARK that could damage other users' computers or allow unauthorized access to other websites.
It is up to Users to take all appropriate measures regarding the equipment they use to protect said equipment from possible contamination by viruses or intrusion attempts. By equipment, this includes, without being exhaustive or limiting: personal computer, personal digital assistant PDA, Internet access, software programs, and data...
3.7 Users are solely responsible for all content they transmit via the review feature SHARK.
Article 4 – Moderation and Publication of Reviews
4.1 Reviews and the accompanying usernames are systematically subject to moderation carried out by software based on predefined keywords by SHARK and, in some cases, reviewed by moderators before being posted online on the Site.
SHARK reserves the right not to publish any review that contravenes the provisions set out in these Publication Conditions. If applicable, the User will be informed by an email notification.
SHARK does not modify reviews but may correct minor spelling or typing errors without change the meaning of the submitted review. Furthermore, SHARK also reserves the right to delete a review at any time that does not comply with the Terms of Use.
Once submitted, a review can no longer be modified by the User.
4.2 Reviews are generally published within two to four business days from their submission by the User, subject to compliance with the Publication Conditions.
The User will receive an email confirming the publication of their review or, failing that, informing them of its rejection. Any subsequent use of the review under the conditions set out in article 1.2 above will not result in the sending of a new email.
4.3 Once a review is published on the Site, internet users have the option, via a link provided for this purpose, to indicate whether they found it useful or not and to report content they deem inappropriate. If applicable, SHARK will review the reports and may delete a review that does not comply with the present terms.
4.4 Reviews are published on the Site for a maximum duration of 10 years. They may be deleted by SHARK before this deadline if they pertain to a product no longer marketed by SHARK or whose characteristics have been so modified that they render the reviews irrelevant.
Article 5 - Intellectual Property
5.1 SHARK holds all intellectual property rights both on the structure and the content of the review functionality of the Site (including but not limited to: texts, logo, images, illustrations, photographs, videos, graphic or sound elements, music, icon, layout, charter graphic, software, databases, etc.) or has regularly acquired the rights/authorizations allowing their exploitation. All brands and/or logos reproduced on the review functionality of SHARK are the exclusive property either of SHARK, or of their service providers, partners, or suppliers.
Any use of these elements, in any manner and for any purpose other than the use strictly necessary for the dissemination of the User's review as defined herein, is prohibited unless expressly, in writing, and prior authorized by the company SHARK or the holder of the concerned intellectual property rights.
In general, the User is prohibited from infringing on the intellectual property rights (copyright, related rights, sui generis right of the database producer, trademark rights, domain names, etc.) of SHARK, of the 2ride group companies and/or any third party. Any unauthorized or abusive use of intellectual property rights may result in the taking of any appropriate measure or sanction by SHARK or any concerned third party.
5.2 By submitting their review on the Site, Users expressly and freely consent to the company SHARK broadcasting, reproducing, and representing all or part of their reviews as well as their pseudonym by any means of reproduction and representation and on all media worldwide for a duration of 10 years.
The media used may include graphic and paper media, audiovisual, computer and digital communication media such as CD-ROM, DVD, electronic communication services (notably the merchant sites of the Group 2ride and/or any possible variation on mobile device) and the marketing and/or advertising communication media (emailing, mailing, Internet advertising banners, promotional materials in stores SHARK ...) published by SHARK, and all known or future media.
This authorization notably includes the possibility for SHARK to freely and gratuitously use all or part of the reviews and pseudonyms, to reproduce them, delete them in whole or in part, adapt them, publish them, translate them, create derivative works, sell them, distribute them notably for commercial, promotional, and advertising purposes.
Article 6 - Personal Data
As part of the review feature, SHARK collects personal information (notably email, username, city, age range, gender, skin type, eye color) from Users who leave a review on the Site.
Only the fields followed by an asterisk on the collection form are mandatory information to be able to leave a review on the Site. Otherwise, the User will not be able to submit their review.
Users are informed that all or part of their personal data thus collected by SHARK may be used by the latter, and if applicable by its service providers, for the dissemination of the review on the current and future public communication media of SHARK, notably and without limitation the electronic communication services (notably the merchant sites of the Group 2ride or any possible variation on any mobile device) and/or marketing and/or advertising communication media (emailing, mailing, Internet advertising banners, promotional materials ...) published by SHARK.
The personal data that will be used for this dissemination may be: the username, city, age range, and gender.
To comply with its legal obligations, SHARK may also collect and retain data likely to allow the identification of anyone who contributed to the creation of online content.
