In France, wearing a helmet became mandatory on July 1, 1973.
This measure followed a decree published on June 28, 1973, requiring all drivers and passengers of motorized two-wheelers to wear an approved helmet, both in cities and outside urban areas.

Before this date, wearing a helmet was recommended but not systematic. With the increase in motorcycle traffic and the number of serious accidents, authorities realized the need for stricter regulation to protect users.

Who is affected by the motorcycle helmet obligation?

The law applies to:

  • all motorcycle, scooter, and moped drivers,
  • all passengers, without exception,
  • all types of trips: urban, road, or highway.

The helmet must be approved, comply with current standards, and be correctly fastened. A poorly fastened helmet is considered non-compliant by law.

What are the penalties for non-compliance?

Not wearing a helmet is an offense under the Highway Code.
Penalties may include:

  • a fine,
  • a deduction of points from the license,
  • and direct endangerment of the driver or passenger.
